Terms and Conditions

1. Project Scope and Costs

1. Our estimates are based on the information you provide about your needs and timeline. Any changes — even minor ones — may affect the cost. Please confirm your requirements in detail during meetings or discussions.

2. By accepting a quotation, you agree to Peak Ranker LLC’s policies and terms. This acceptance may be verbal, by email, through payment of a deposit, or by signing the quotation.

2. Client Responsibilities

1. Clients must ensure that all required details are included in the initial quote and that our team fully understands all requirements. Clear guidelines and timely information help us deliver accurate work. Any changes or missing details may result in additional charges.

2. Specific tasks or nuances must be clearly defined in advance and included in the proposal. Peak Ranker LLC is not responsible for discrepancies due to incomplete or unclear information.

3. Work Hours and Changes

1. Each project is allocated a set number of hours. Minor changes within this timeframe are acceptable. Significant changes will be reviewed and may incur extra fees.

2. We aim to deliver projects within the agreed timeframe. If features or functions are reworked or altered, reasonable delays are accepted.

3. Client delays may require rescheduling and could increase costs.

4. Bugs, Refunds, and Rework

1. We do not provide refunds except at our sole discretion or as required by law.

2. Bugs (programming errors) reported during or immediately after development will be fixed without additional charges.

3. Rework on completed tasks or changes to approved layouts may require extra fees.

5. Additional Changes & Go-Live

1. Any changes requested during development or after Go-Live approval will incur extra charges.

2. Peak Ranker LLC is not responsible for issues caused by client-requested changes after project approval.

6. Content and Deliverables

1. Clients must provide all content and materials within the first two weeks of the project. Delays in content delivery may delay the project and could add extra costs.

2. Our websites are tested on current PC versions of major browsers (Chrome, Firefox, Safari, Edge). Please notify us in advance if you need testing on additional browsers or devices.

3. We test responsive compatibility on iPhones and iPads. If you’d like testing on other devices, please inform us beforehand.

7. Hosting and Servers

1. If you choose not to host with Peak Ranker LLC, extra time required due to third-party hosting or server issues will be charged separately.

2. Hosting fees are not included unless specified. We can provide a hosting quote if needed. If you choose your own host, please coordinate with us to meet technical requirements.

8. Project Holds and Stalling

1. Projects that stall for over two months will incur a $99/week admin fee and may require updated quotes. Placing a project on hold requires prior notice.

2. There is no extra charge to put a project on hold, but we must update the account accordingly.

9. Intellectual Property and Code Ownership

1. All custom code written by Peak Ranker LLC is protected by copyright. Once final payments are made, code may be licensed for the client’s use. Resale or duplication is prohibited.

2. Clients receive a license for exclusive use of custom code as part of the hosting package. This license does not transfer to other hosts or providers without written consent.

10. Third-Party Elements

1. We are not liable for third-party software, plugins, or licenses (such as WordPress, open-source carts, SSL, payment gateways, Google Ads, etc.). Additional costs for these are not included in our estimates.

2. Changes in third-party provider rules or limitations may affect services.

11. Delays and Dependencies

1. We work diligently to stay on schedule. However, delays can occur. If we make a reasonable effort to remain on track, we cannot be penalized for delays beyond our control.

12. Domain & Hosting

1. Domain registration, renewals, and related fees are not included unless specified. These costs will be quoted separately if requested.

2. We test websites on our servers during development. Direct third-party server access is only granted after full payment of all invoices and dues.

13. Rights to Visuals and Content

1. Once all invoices are paid in full, Peak Ranker LLC grants the client the right to use all visual elements, writing, and photos on their website. Intellectual property used to create the site (like databases, scripts, or forms) remains the property of Peak Ranker LLC unless otherwise agreed.

14. Communication

1. Email will be the primary method for all official communications. Clients must keep us updated with their current contact information.
